Descarty, Inc. (the “Company”) sets out this privacy policy (the “Policy”) for how it handles users’ personal information in the services it provides on this website (the “Services”).

Article 1 (Personal information)

“Personal information” means personal information as defined in Japan’s Act on the Protection of Personal Information: information about a living individual that can identify that individual by the name, date of birth, address, telephone number, contact details, or other descriptions it contains, and information that can identify an individual on its own, such as data on appearance, fingerprints, or voiceprints, or the insurer number on a health insurance card (personal identification codes).

Article 2 (How personal information is collected)

The Company may ask for personal information such as name, date of birth, address, telephone number, email address, bank account number, credit card number, and driver’s license number when a user registers. The Company may also collect records of transactions and payments that include a user’s personal information, made between the user and the Company’s partners (including information providers, advertisers, and ad distributors; “Partners”), from those Partners.

Article 3 (Purposes of collecting and using personal information)

The Company collects and uses personal information for the following purposes:

  1. To provide and operate the Company’s services
  2. To answer inquiries from users (including verifying identity)
  3. To send emails about new features, updates, and campaigns for services the user is using, and about other services the Company provides
  4. To contact users as needed, such as about maintenance or important notices
  5. To identify users who violate the terms of use or attempt to use the services for fraudulent or improper purposes, and to refuse their use
  6. To let users view, change, and delete their own registration information and view their usage
  7. To bill users for paid services
  8. For purposes incidental to the above

Article 4 (Changes to purposes of use)

  1. The Company changes the purposes of use of personal information only where the new purpose is reasonably recognized as related to the previous one.
  2. When the purposes of use change, the Company notifies users of the new purposes in a manner it determines, or publishes them on this website.

Article 5 (Provision of personal information to third parties)

  1. The Company does not provide personal information to third parties without the user’s prior consent, except in the following cases and where otherwise permitted by the Act on the Protection of Personal Information or other laws:
    1. When necessary to protect a person’s life, body, or property and it is difficult to obtain the user’s consent
    2. When especially necessary to improve public health or promote the healthy development of children and it is difficult to obtain the user’s consent
    3. When cooperation is needed for a national agency, a local government, or a party entrusted by either to carry out duties prescribed by law, and obtaining the user’s consent could impede those duties
    4. When the Company has announced or published the following in advance and notified the Personal Information Protection Commission:
      1. That the purposes of use include provision to third parties
      2. The items of data provided to third parties
      3. The means or method of provision to third parties
      4. That provision to third parties stops at the person’s request
      5. How such requests are received
  2. Notwithstanding the preceding paragraph, the recipient of information in the following cases is not a third party:
    1. When the Company entrusts all or part of the handling of personal information within the scope necessary to achieve the purposes of use
    2. When personal information is provided as a result of a merger or other succession of business
    3. When personal information is used jointly with specific parties, and the user has been notified in advance, or can easily learn, of that fact, the items of personal information used jointly, the scope of joint users, their purposes of use, and the name of the party responsible for managing the personal information

Article 6 (Disclosure of personal information)

  1. When a person asks the Company to disclose their personal information, the Company discloses it to that person without delay. The Company may, however, withhold all or part of it where disclosure would fall under any of the following, and notifies the person without delay when it decides not to disclose. A fee of 1,000 yen is charged per disclosure.
    1. Disclosure could harm the life, body, property, or other rights and interests of the person or a third party
    2. Disclosure could seriously hinder the proper conduct of the Company’s business
    3. Disclosure would otherwise violate laws or regulations
  2. Notwithstanding the preceding paragraph, the Company in principle does not disclose information other than personal information, such as history and attribute information.

Article 7 (Correction and deletion of personal information)

  1. When personal information the Company holds about a user is incorrect, the user may ask the Company, through the procedure it specifies, to correct, add to, or delete it (“Correction”).
  2. When the Company receives such a request and determines that it should comply, it makes the Correction without delay.
  3. The Company notifies the user without delay when it has made a Correction under the preceding paragraph or decided not to.

Article 8 (Suspension of use of personal information)

  1. When a person asks the Company to stop using or to erase their personal information (“Suspension”) on the grounds that it is being handled beyond the purposes of use or was obtained by improper means, the Company investigates without delay.
  2. When, based on that investigation, the Company determines that it should comply, it carries out the Suspension without delay.
  3. The Company notifies the user without delay when it has carried out a Suspension under the preceding paragraph or decided not to.
  4. Notwithstanding the two preceding paragraphs, where Suspension would be very costly or otherwise difficult, and alternative measures needed to protect the user’s rights and interests are available, the Company takes those alternative measures.

Article 9 (External services and provision to third parties in other countries)

  1. The Company uses Web3Forms, a form delivery service, to send information entered in this website’s inquiry and material request forms to the Company. The information is delivered through that service to the Company’s email address. The service is provided by Web3Creative, a business in India, and processes information on servers in the United States.
  2. The Company uses PostHog, an analytics service, to understand and improve how this website is used. PostHog uses cookies and similar technologies to collect information such as pages viewed, referrers, and device and browser types. The service is provided by PostHog, Inc., a business in the United States, and processes information on servers in the United States. Names, email addresses, and other information entered in forms are not sent to PostHog.
  3. For information on the personal information protection systems of India and the United States, see the materials published on the Personal Information Protection Commission’s website (https://www.ppc.go.jp/). The Company has confirmed the measures these providers take to protect personal information through their published privacy policies and similar documents.
  4. Users can disable cookies in their browser settings.

Article 10 (Changes to this Policy)

  1. Except where laws or this Policy provide otherwise, the Company may change this Policy without notifying users.
  2. Unless the Company specifies otherwise, a revised Policy takes effect when it is posted on this website.
